Consequently it is argued here that the critical assumption is not the adoption of arrangements such as the draft or the reserve clause system, but the assumption that for each team there is only a limited and intrinsically local market available, although these will be of different sizes.

The identity of the sport as an abstract entity is separate from those who play, especially as a set of rules. In the early evolution of modern sport – most often before the global level was achieved – this area was usually in the hands of a few individuals. In creating the rules that defined the sport they also formalised it. While this was often for their own ends they were in fact creating a public good that they could not entirely control as a played sport even under the governance of the GSO.
